German Abstract: Das Bundesverfassungsgericht hat in mehreren Verfahren zur europäischen Wirtschafts- und Währungsunion grundlegende Entscheidungen in Hinblick auf das deutsche Demokratieprinzip (Art. 20 Abs. 1, 2 GG) verkündet. Im Rahmen des Kooperationsverhältnisses zwischen dem Bundesverfassungsgericht und dem Europäischen Gerichtshof ist im Urteil des Bundesverfassungsgerichts zum PSPP-Anleihekaufprogramm ein Konflikt offen zu Tage getreten, der zuvor unter der Oberfläche geschwelt hatte. Die relevanten Argumente in dem Konflikt sind im Lauf des letzten Jahres diskutiert worden. Ein weiteres wichtiges verfassungsgerichtliches Verfahren für die Wirtschafts- und Währungsunion betrifft nun den europäischen Wiederaufbaufonds zur wirtschaftlichen Bewältigung der Covid 19-Pandemie. Dieser Beitrag richtet den Blick nach vorne und erörtert, wie das Verfahren genutzt werden könnte, um die verfassungs- und unionsrechtlichen Vorgaben zusammenzuführen und auch das Kooperationsverhältnis zwischen Bundesverfassungs-gericht und Europäischem Gerichtshof wiederherzustellen.English Abstract: In several proceedings concerning the European Economic and Monetary Union, the Federal Constitutional Court of Germany has handed down fundamental decisions with regard to the German principle of democracy (Article 20 (1) and (2) of the Basic Law). Within the framework of the cooperative relationship between the Federal Constitutional Court and the European Court of Justice, a conflict that had previously been smoldering under the surface has come to light in the Federal Constitutional Court's ruling on the PSPP bond purchase program. The relevant arguments in the conflict have been discussed over the course of the past year. Another important constitutional court case for Economic and Monetary Union now concerns the European Recovery Fund for the economic management of the COVID-19 pandemic. This article looks ahead and discusses how the proceedings could be used to bring together the constitutional and Union law requirements and also to restore the cooperative relationship between the Federal Constitutional Court and the European Court of Justice.
